Frequently Asked Questions

Please reach us at sean@perrislivingtrust.com if you cannot find an answer to your question.

A living trust is a powerful estate planning tool that allows you to maintain full control of your assets—such as your home, bank accounts, and personal property—during your lifetime, while also ensuring those assets are smoothly transferred to your chosen beneficiaries after your passing.

Unlike a will, a living trust helps your loved ones avoid the time, expense, and stress of probate court. This means your estate can be distributed more quickly, privately, and efficiently, according to your wishes.

With a living trust, you can:

  • Stay in control – You manage and use your assets just as you normally would while you’re alive

  • Plan for incapacity – If you become unable to manage your affairs, your chosen trustee can step in without court involvement

  • Avoid probate – Your assets pass directly to your beneficiaries without court delays

  • Protect your family’s privacy – Trusts are not public record like probate cases

  • Customize distribution – You decide who receives what, when, and how

A living trust is especially beneficial for homeowners, families with children, and anyone who wants a clear, organized plan in place for the future.

A Will, also known as a Last Will and Testament, is a legally prepared document that clearly outlines your wishes for how your assets and personal belongings should be distributed after your death. It allows you to decide who will receive your property, money, and other valuables, rather than leaving those decisions up to the court.

A Will also gives you the ability to name trusted individuals to carry out your wishes. You can appoint an Executor, who is responsible for managing your estate, paying any debts, and ensuring your assets are distributed according to your instructions.

For parents, a Will is especially important because it allows you to:

  • Name a guardian for your minor children – ensuring they are cared for by someone you trust

  • Provide instructions for your children’s care and financial support

  • Avoid uncertainty or family disputes about who should take responsibility

With a properly prepared Will, you can:

  • Clearly state who receives your assets and in what proportions

  • Designate an Executor to handle your estate

  • Provide specific gifts (such as vehicles, jewelry, or personal items) to loved ones

  • Ensure your wishes are legally documented and recognized

It’s important to understand that a Will typically must go through probate, which is a court-supervised process that can take time and may involve additional costs. However, having a Will in place still provides essential guidance and legal clarity for your loved ones during a difficult time.

An Apostille is a certification issued by the California Secretary of State that verifies the authenticity of a public official’s signature on a document. This certification allows your document to be legally recognized and accepted in foreign countries that are part of the Hague Apostille Convention.

In simple terms, an Apostille confirms that the signature, seal, or stamp on your document is valid—so it can be used internationally without further authentication.

Apostilles are commonly required for documents such as:

  • Birth, death, and marriage certificates

  • Powers of Attorney

  • Notarized affidavits and declarations

  • School records and diplomas

  • Business documents and corporate filings

This process is often needed for use in countries like Mexico, Spain, Italy, and many others.

Apostille documents are processed the same day at the California Secretary of State office once submitted.

For your convenience, we personally handle weekly submissions to ensure a smooth and reliable process:

  • Drop-Off to Secretary of State: Every Thursday in Los Angeles

  • Pick-Up of Completed Apostilles: Friday

This schedule allows for fast turnaround and consistent service for our clients.

In the rare event that we are unable to make our scheduled run, you will be promptly notified and provided with an updated timeline.

We handle the entire process for you—so you don’t have to deal with long lines, travel, or uncertainty.

A Notary Public is a state-appointed official who serves as an impartial witness during the signing of important documents. Their primary role is to help prevent fraud by verifying the identity of the signer and ensuring that documents are signed willingly and knowingly.

Notaries are commissioned by the state—typically through the Secretary of State—and are trusted to uphold strict standards of integrity and professionalism when performing notarial acts.

A Notary Public helps protect all parties involved by:

  • Verifying identity – Confirming the signer is who they claim to be through valid identification

  • Ensuring willingness – Making sure the signer is not being forced or coerced

  • Confirming awareness – Ensuring the signer understands what they are signing

  • Witnessing signatures – Acting as an official, unbiased third party

Common documents that require notarization include:

  • Powers of Attorney

  • Living Trusts and Estate Planning Documents

  • Grant Deeds and Real Estate Documents

  • Affidavits and sworn statements

  • Travel consent letters for minors

A notarized document carries added credibility and is often required for legal, financial, and international transactions.

In the United States, anyone can certify a translation. A translator does not need to be certified in order to provide a certified translation. The individual translator can certify their translations, as can an employee of a translation company.  A translator may also certify someone else's translation—as long as the translator has fully reviewed the translation for accuracy and completeness and the translation will not be changed after being certified.  The certification statement must specify whether the signer has translated or reviewed the translation.
